Since Sony is trying to emulate the EE via software, then they test every single game. If some games play just fine via software, they'll consider it good. If there are issues, Sony will eventually go through and resolve it, to make it work. They don't have to do what MS does, which is emulate every game seperately (due to not owning some of the Xbox hardware rights, like the graphics chip).
I knew someone who was a BC games tester for SCEE (I believe around Liverpool), but I never asked him how Sony chooses.
